SWIMMER Nick D’Arcy risks losing his passport and killing off his chances of going to the London Olympics by declaring himself bankrupt.
D’Arcy has reportedly filed for bankruptcy which would allow him to avoid paying a $180,000 damages bill for assaulting fellow swimmer Simon Cowley.
But, in doing so, he may have ruled himself out of selection for next year’s London Games.
According to federal government agency Insolvency Trustee Services Australia, during a period of bankruptcy “If you wish to travel overseas you must obtain the written permission of the trustee administering your estate who may impose conditions of travel. You may have to surrender your passport to your trustee.”
The court-appointed trustee will decide whether D’Arcy can travel overseas.
D’Arcy, 24, was kicked out of the Australian team for the Beijing Olympics in 2008 after he assaulted Cowley in a Sydney bar on the night he was selected for the Games.
Free trialHe is currently the best 200m butterfly swimmer in Australia and is likely to be in the team for London.
The Australian Olympic Committee has no rules preventing a bankrupt from being selected.
The AOC’s team executive, consisting of chef de mission Nick Green, secretary-general Craig Phillips and former swimmer Chris Fydler, is due to meet today to discuss D’Arcy’s latest development.

2 - I was managing the bar the night it happenedyes, he hit the bloke and shouldn’t have done it; nick does deserve some punishment. However what happened leading up to the elbow-in-the-face is never reported by the media. The severity of the ‘attack’ is also exaggerated beyond facts. You know, “the whole story” and all that stuff.
But hey, I guess we can attack one nice bloke for hitting a douchebag (Darcy) whilst defending another nice bloke hitting a douchebag (Benji)

Yep… My understanding of the situation which resulted in the assault, is not many were suprised this happened to Cowley?!
His lawyer is very astute to ensure this has crept back into the media… But then again, the whole scenario has been played there.
FYI - Many people litigated against for damages from assault file for bankruptcy.

Yes when we talk about these type of subjects we have to remember that people die almost every weekend through the silly actions of some . Before I get castigatedI have never instigated a fight drunk ever .

I know you said he deserves some punishment - but you also believe he has been “screwed by a douchebag”. I just can’t see how Crowley is a winner out of any of this - besides looks like he wont get a dime.
Anyway I don’t know either of the guys personally. At the end of the day you are right in saying that the media has done a mighty fine job of making Darcy the dog and Crowley the innocent victim. I am sure Darcy is a decent bloke - and I actually believe that anybody can be pushed to a point that they want to belt someone, I reckon a lot of us have been there. The whole affair is unfortunate really - and probably all to common.
As a witness to the assualt and the lead up - were you questioned by police? Or involved in the case?

The standard rule is the passport is collected however if income stream is to be increased by someone going overseas I would suspect his creditor/s would be in favor of Darcy going overseas to drive income during the bankruptcy period as that is the only way he will obtain income to assist in someway of money being retrieved
