Just wondering why she gets in contact with the club rather than Police?

//The woman at no time indicated she intended to report the matter to anyone other than the club and Barba's management.//

It all sounds very strange.

Also, perhaps she didnt' want him in serious **** with the police, record, likely massive penalty from the NRL. To deal with it a bit more privately was probably what she wanted im guesssing.

**If true Hasler and Greenberg could be in serious trouble for failing to report a serious criminal offence, which assault causing actual bodily harm is.**

It is really important that the police pursue to this as failing to report such crimes is a social and community problem.

Its made worse that they misled the girl by saying he wouldnt play again if she reported him. There was no basis for making such a statement.

At the time - as it still is now, they are allegations, not a crime.
Its not up to them to report this….its up to the victim.

As with ben teo...weve seen this before.

Ink youre wrong buddy. The law places on obligation on people to report serious criminal offences irrespective of whether they are the victim.

Fair enough southern, im no lawyer, only guessing

Interesting

Would Greenburg & Hasler be clear of this law by acting as representatives of a club/organization, and not ''a person/s" as such?

Where's this money coming from?

She coulda gotten a lot by going to the media…

He is the father of her kids you know

Perhaps.

The application of the section of the Crimes Act I linked to you depends upon the offence that was concealed being a serious indictable offence, which means a crime punishable by 5 years in prison. It doesnt matter whether Barba would have got 5 years merely that the offence was one that is potentially punishable by 5 years in prison.

Common assault is not a serious indictable offence. However, assault occasioning actual bodily harm is a serious indictable offence.

Accordingly, the issue I raised depends upon whether Barba's assault caused actual bodily harm.

Im not a criminal lawyer but I would have thought a bloody mouth with bruising (as the photo suggests happened) is actual bodily harm.

I should say the police rarely take action under the provision I cited.

I should qualify it by saying the above makes several factual assumptions based on the content of the articles. Hardly great evidence.
