The Sydney Morning Herald reports that the hooker has yet to speak to police over the incident, which erupted at a dance in Liverpool on Friday.
Fainu was in attendance at the function when a fracas broke out.
One of the men involved in the melee was stabbed, but there is no suggestion Fainu was responsible, although he remains a person of interest to the police.
The hooker’s lawyer, Elias Tabchouri, told the Sydney Morning Herald: “Mr Fainu has again retained me and there arrangements are being made to hand himself into police to allow these matters to be processed.
“Mr Fainu had previously sought to hand himself into police but unfortunately police were not available on the day.
“If and when he is charged, the allegations will become clearer.
“At that point in time we will be in a better position to properly comment on the matter.”
Fainu edged out Api Koroisau at Brookvale Oval this season, with the latter now moving onto Penrith.
Earlier in the year Koroisau described Fainu as a future Sea Eagles captain,
“He’s 21 years old, he’s played (more than) 25 games and he’s already talking to everyone,” Koroisau said.
“(Daly) Cherry-Evans is a 200-game vet and he’s telling him what to do and where to go. They just converse like they are best friends.
“For these young players, it’s hard to have that leadership quality and it’s usually gained over a long period of time, whereas he has come to it and walked straight in.”
