Brett Stewart fronts up to face sex assault charges

Stewart, 24, is alleged to have had sexual intercourse with the girl, following the club's boozy season launch. He is alleged to have also indecently assaulted the girl by forcing his tongue into her throat.

As Stewart's committal hearing began at the Downing Centre Local Court, his barrister Clive Steirn, SC, told Deputy Chief Magistrate Paul Cloran that Stewart had diabetes and may need to sip on juice occasionally to maintain his blood sugar levels.

The hearing was adjourned for one hour while Mr Cloran reads medical evidence and statements from the alleged victim and her family and a psychiatrist the girl has been seeing.

The court heard the alleged victim's father is overseas and a decision in the case will most likely be delayed until April or May when he is able to give evidence.

So does that mean he's free to play round 1?

I would imagine the effects of alcohol on a diabetic are being established as a fall back defence

Not wishing to jump the gun, the diabetes issue would only be a possible mitigating factor at the time of post-trial sentencing, not actually any reason for defence during any possible trial, as this is a sexual assault case, not murder.
 
Not mitigating at all.

But the earliest it can be raised to the public arena the more affect it will have on the public aka: potential jury pool

So true smeg, there's always a method/reason to any action by a defense lawyer.

BRETT Stewart has been ordered to stand trial on counts of sexually assaulting a 17-year-old girl after a dramatic hearing in which a magistrate heard the Manly star insisted "I didn't touch her" when confronted by the girl's father.

In Sydney's Downing Centre Local Court today, Deputy Chief Magistrate Paul Cloran ordered the 24-year-old fullback to face a NSW District Court trial, which will be mentioned in that court on April 9.

The magistrate concluded there was a reasonable prospect a properly instructed jury could convict Stewart of an indictable offence.

The footballer, who appeared at the court on crutches, is charged with having sexual intercourse, involving digital penetration, with the girl without her consent on the evening of March 6, 2009, at North Manly.

He also is charged with assault with an act of indecency, namely that he "forced his tongue into her mouth".

Stewart, who told the magistrate he would reserve his defence, had his bail continued.

It came after the alleged victim's father, who cannot be named as it would identify his daughter, gave evidence.

He told the court his daughter had been outside smoking when she ran into the kitchen upset and shaking.

At first she could not get the words out but then told him a man had touched her, and that he was nearby and wearing a suit.

The father said he went outside and saw a man standing under a tree and when he asked his daughter "is that him?" she replied "please dad, please dad".

The man then called out "I didn't touch her bro" and repeatedly denied the claim when the father put it to him.

On a scale of 10 to zero - from drunkenness to sobriety - the father said the man was very drunk and rated him at eight.

He said the man repeatedly said "you know who I am".
