He signed a contact end of story what's the difference between him and and other employment contracts .

You perform badly in your job you get sacked?

AS a business owner that would be the ideal way of getting rid of people.. dont do you job, YOUR OUT!!! ITs not that simple though

for 1: he is under contract..
2: He must be councelled by the people above him and shown how its done to their standards or better if they feel he isnt doing the right job.
3: must have 3 warnings if not doing the correct job at hand.
4: Those 3 warnings have to be done with in 12 mths.. (this is an old rule so it may not apply still)

Just cause he is a coach who didnt do the job for team he still falls under a normal job like the rest of us. If he was given a contract, he is entitled to his money.. There is no iffs or butts…. he is entitled to it.. full stop.......

its now July, and people are still worried about him.. nothing can be changed and it wont in public....

I can just see Sheens' written warning;

# in round 17, you picked a winger on the interchange bench, which ultimately led to fatigued forwards and a 17% increase in missed tackles

# in round 1,3,4,6,7,8,9,11,12,14… You changed the halves pairing without justifiable reasoning. Hence, our attack was somewhat disjointed.

# you employed Royce Simmons as a defensive coach. No explanation required

Ah… the difference is that you actually have to be doing some work if you're employed

lol there was an agreement

pay the money or go to court and cost more money

All the blame is entirely with the board and or the ex-ceo in regards to Sheens.

I can't believe most of the people on here. Sheens didn't hold a gun to their head when he signed the last contract.

Thanks Rhys3 but the adults are talking

Without seeing the contract it is hard to comment. However, most coaching contracts are fixed term meaning that if you want to terminate early you must damages to the coach. This will be the value of the contract minus any income they pick up from a new coaching gig.

It has nothing to do with warnings unless you intend to terminate for cause. A failure to get results is very rarely a basis for terminating for cause. No decent coach would allow such a clause in their contract.

The club attempted to avoid paying damages by offering Sheens a different position in the club. Presumably they considered his refusal to accept such a role may mean that he would not have satisfied his duty to mitigate his loss. A failure to mitigate impacts the amount of damages the other party must pay.

However, there is a question of whether it is reasonable to expect a career coach to accept a non-coaching role as part of his duty to mitigate. I would think not.

At the end of the day without seeing the contract it is mere speculation.

imo sheens got demoted and may/may not have been paid the same salary
his ego got in the way and the denial of his failure that he didnt accept that job.

There have been severable questionable decisions made by the Wests Tigers over the past three or four years. I remember the "sacking" of the previous CEO (was it Longmire?) for daring to try to bring Sheens to account, the appointment of Humphreys (I thought this was a GOOD move at the time!) and the panic re-signing of Sheens because Penrith were supposed to be sniffing around.
I am sure all of these decisions emanated from the Board. If there is any blame to be apportioned, it should be sheeted home to them.

Definitely the employers fault not the employee. There should of been at least one performance clauses in that contract at minimum!
