Benji Marshall to face court over assault

NRL star Benji Marshall will face a court hearing in August over a charge of assaulting a man at a McDonald's restaurant in Sydney.

The Wests Tigers star and New Zealand captain did not appear in the Downing Centre Local Court on Friday, when the three-day hearing was scheduled for August 23.

Named in court papers as Benjamin Quentin Marshall, 26, of Breakfast Point, he is accused of assaulting Soliman Naimey, occasioning actual bodily harm.

He is alleged to have attacked the man in the early hours of the morning at the fast food outlet on George Street, in Sydney's CBD, on March 5.

His lawyer, John Byrnes, said 14 witnesses would appear for the prosecution, and up to four for the defence.

Outside court, he declined to say who they were.

A medical certificate might also be tendered, he told Magistrate Lisa Stapleton.

A not guilty plea was entered on Marshall's behalf at a court mention in April.

Gee a medical certificate . Let me guess injuries have become life threatening and critcal and he will never be able to work again

Where you there? If not then what was said or not and who is telling the truth and what actions occurred will be decided by the court, not us the general public. This statement is treading dangerously close to being actionable.
 
I wonder what position Gallop is gona take if Benji is found guilty? At the end of the day, it would appear Benjamin 'HAS' assaulted this bloke…
 
Mods please shut this thread down unless you wish to see the site shut down or see individuals sued. Tiger Watto comments like that are completely out of order and as a Moderator unacceptable.
 
Maybe someone who has more experience in these sorts of matters can answer, but is it a bad sign that there are 14 witnesses for the prosecution and only 'up to 4' for the defence? Unless the other guy had 14 friends with him and Benji only 4…
 
The number of witnesses called by either side means nothing. The prosecution has a duty to call all available witnesses so as to assist the Court in reaching a true verdict according to the evidence.
Defence witnesses can often be people who weren't present but who know the accused and they testify as to his good character.
Or the defence might call witnesses that the police omitted to take a statement from.
So – like all criminal cases once the hearing starts, anything can happen and probably will.

Thanks for the info Monty. Hopefully everything will work out fine and Benji can get on with the job of winning the comp.
