Jordan Kahu & contractual obligations

As most forum members would be aware Peter Sterling Medallist and Keebra Park captain Jordan Kahu is trying to seek a release from his obligations to play NYC w/ the Tigers in 2010-11 to allegedly "be close to his father" having recently fielded counter offers from the Broncos (a'la AJ Taumata)!

Having seen some of the inane posts on another forum attacking the Tigers (& McDonnell specifically) for sticking to our guns & not allowing family to come first I must remind everyone that the Tigers are a business and contracts are binding unless a mutual agreement (w/ compensation to the contractee - that being the Tigers) can be met. In this case both Jordan & the Broncos have nothing to offer in compensation and Kahu needs to man-up and meet his obligations!

Some have argued that the agreement for the previous two years between Kahu & the Tigers is minimal & does not deserve any loyalty from the young bloke - but it was the Tigers who facilitated all his opportunities to be in Australia & at Keebra to make a star of himself!

He was brought out from NZ - but unlike Ben Murdoch who is extremely grateful to our club - Kahu is willing to consider reneging on a contract for a better deal once we helped him make his name (PLUS the Broncos just want to sneak in without doing the job of scouting or development)!

The Tigers have previosuly compassionately released former Keebra boy Kingi Akouala to the Titans as he was not handling Sydney well - however this is not a true compassionate request - it is all about being offered better commercial terms than what he has already signed up to w/ us!!!

It reminds me of Bob Lindner receiving a requested "compassionate release" from Parramatta in 1988 to join the Gold Coast on the grounds that he could not establish an Optometry business in Sydney & QLD would be commercially preferable. He stayed at GC for a grand total of 12 months (no practice was established) & joined Wests Magpies for big money in 1990 !

While some old Maggies will enjoy that reminiscence - as a Balmain boy I am impartial & believe it was a major breach of trust by Lindner in regards to the Eels. Lindner went where the money was!!!

The bottom line (& I know ink agrees) is that Kahu has a contractual obligation & the club is only being professional in enforcing that! Plus the Broncos are a parasitic entity who no longer develop their own & who have zero ethics when it comes to contractual law & enticing players to breach contracts (which is a legally actionable offence)!

If Kahu struggles w/ Sydney & family distance I have no doubt the club would consider a compassionate release (w/ compensation). But until he spends six months w/ the rest of the 20s squad & gets to know Sydney (having grown up in Wellington, NZ) he needs to be a man of principle & flick the Broncos approach!

Why would the club release the kid who is destined to be the next Karmichael Hunt (hopefully **only** on the field) when the low-life vultures want us to???
 
Couldnt agree more he should man up and abide by his contract after all he will soon be an adult not a child if not an adult already..
 
The kid has talent and if he has signed a contract with the Tigers it would be nice if he fulfilled the contract. He's not the first youngster to try and opt out of a contract, but it would be nice if he stayed.

If so - what the frick sort of precedent does that send to any other contracted players - that all they need to do when in form is test the market & if they get a better offer & tell us they are unhappy in Sydney we let them go!!!?????!!!!????

Do you understand that a contract has been signed between Kahu' & the Tigers for 2010 w/ an option for 2011 in the Club's favour & that it is legally binding???

Do you understand that the Broncos actions in offering a larger amount to a contracted player that in any way encourages that player to breach their extant contract with another party is in breach of all common law contractual principles and would be actionable for major damages in any court within the Westminster system????

**NO!!** And on that basis stop telling us that Jason Cayless has signed because you clearly have no idea about contractual law. His agreement to terms is conditional at best!!!

As for whether we can bring Kahu's Dad down - I have no doubt we can because we helped bring him over from NZ! However in this economy I am unsure we could get his Dad an appropriate job in Sydney - but I have no doubts the front office is seeking such from some of our smaller local sponsors.

The fact remains that the kid needs an attitude & reality check! Marshall - Chase - Moa -Parata - T'eo - Lui etc all appreciated the opportunities that our club in combination w/ Keebra provided (despite also being removed from family initially)!

This kid is a prima donna who needs to get his arse to Sydney & work for a top grade contract!

He also has two school mates in Murdoch & Isaac Lui who he will stay w/ at Strathfield/Burwood at the share-house to make any homesickness easier. I am not without sympathy for the kid but he needs to understand the primacy of a contract!

ok if this was a top line FG player i would agree but its a 17 year old kid FFS, he is signed for one more year and its obvious he wont sign with us again so let the kid go its not like he is gonna play FG next year is it

My issue is the Broncos doing nothing in terms of scouting & getting the kid to Australia to get his chance & then trying to gazump us after we & Keebra (who are proudly a Tigers feeder) give him his chance in the spotlight!

In any financial terms our investment in the lad has contributed to his market value - while the leeches in Brisbane have created this conundrum!

He was happy to come to Sydney until Brisbane started waving cash & extra-curricular priviliges at him!!!

Yeah but this is the world we live in snide an loyalty in league is pretty much gone these days. Sure, you'd like Kahu to stay, I'd like to see if he handles the step up in class and if he does then I'd like to see him stay too if he produces the goods on the field, but in reality if he's not happy here he WILL do something about it, whether yo or I deem it as being right or wrong or if it upsets the fans or not.

Thanks mate - I can see that you also see my anguish - yet remain realistic.

My biggest issue is not so much w/ Kahu - but with the Broncos whose conduct in any commercial context is unconscionable!

I believe we need to stay firm & let the kid become acclimatised w/ Sydney in the short visits he will initially make before settling in. He will mature & may see that he has a home here!

Wests Tigers look after young talent better than most....McDonnell is heavily involved in that process.....Those that don't care to much for him and what he does for the young kids at our club mainly do so because of his so called percieved bias toward certain players.....

On Kahu I agree he should be encouraged to honour his contract agreement....trouble is I think your smart enough to now things arn't always that simple...

Who knows when our Cubs win the Grand Final tommorro his Dad may have a change of heart......

We dont know that. 12 months is a long time and maybe in that 12 months he'll find out he loves Sydney and the Tigers, maybe he'll fall in love with a Sydney girl and never want to return to QLD. U just never know.

Im on the fence with this one. On one hand he should be made to honour his contract and maybe what i stated above may happen, but on the other hand, i dont like making someone play for us that doesnt want to. Whatever happens ill live with on this one.

If the kid wont honour his commitments than I say he is a dog and we dont need that sort of player at the tiges.

Brisbane are just doing what they always do....
 
When does official training start, October/November ….....

Guess time will tell if he really wants to progress his footy career.
