Yes its different, but neither are images that the NRL would want being shared in public. Lets also not forget that there is another person in the video that may not have wanted that shared especially if people know who she is.

I haven't heard that Napa didn't know he was being filmed. Even if so, that's a police matter. Unless the girl says she didn't want it released, there's no problem really for the NRL. That of course is if they were sane, which they are Not. So who knows.
