Benji Marshall Assault Charge Dismissed

I was on fox sports news channel last night the back page was on and paul kent said benjii will be fine and 2day the case will be done and dusted so its today no more till 2moro :smiley:😀
 
I'm absolutely puzzled now its been made clear there is no CCTV evidence of the actual assault… When the Police charged Benji, they made the comment like "after reviewing the CCTV footage, it is a clear an assault has occured"...

Unless the Proscecutors are gona pull a rabbit out of a hat, I'd highly doubt the Defence will even need to call any of there own witnesses. Once the Proscecutors are finished, surely Benji's defence team will ask for the charges to be dissmissed???

This is now a joke... A drunk idiots story versus a reputable community figure!!!
 
It Really annoys me that some random halfwit that is drunk and carrying on like a fool can just make a complaint and this ends up in the courts What a complete waste of time!!! Surely the cops and the lawyers and all involved have bigger fish to fry. i hope this fool Is laughed out of court and Charged with wasting the courts time or something.

Maybe due to the time of the incident and from the angle of the incident they can see the alledged victim being struck but can't tell who struck him . Thats the only explanation I can think of Willow
 
It seems a bit strange that he's alleging Benji's mate hit him too, and yet the police said at the time there was no evidence of a third person being involved (http://www.theaustralian.com.au/news/breaking-news/no-third-person-in-benji-marshall-assault-case-police-say/story-fn3dxity-1226016912331), and no other person has been charged.
 
Yeah that's what baffles me Tiger_Terrific. Even the prosecution witnesses suggest Benji pushed the "victim" in the mouth or at worst through a very soft jab and yet they all say another person punched him a lot harder straight afterwards. Yet Marshall is the only one charged?

You don't want to see celebs benefit from their fame in these matters but in this case it appears Marshall is being punished because he is well known (and thus identifiable) while his friend (who nobody is concerned about) is not.

I'd hate to think what would happen to our courts though if this kind of stuff warrants a 3-day trial. The coppers would be very busy writing up charges on a Friday night in town if that's where the bar is being set.

Marshall said he "absolutely did not" punch Mr Naimey. Also apologises to magistrate for his beard, saying he's growing it for charity.

It is the same kids cancer charity that he was raising money for on the night of this incident. "I didn't mean to look so scruffy" he says

Benji says he would never be offended by someone saying Locker is a better player than him. "Why would I, he's my hero," he tells court.

Benji says his job at the Wests Tigers is "to make the outside backs look good" #zing - hahahaha

Benji has completed his evidence after about 30 mins in the stand. Next witness to be called is…swimming legend Dawn Fraser

I think the prosecution are happy with the statement he made regarding fending his accuser away as they will argue in closing it adds to the validity of their case etc etc
 
It's all looking a bit "your word vs mine" which is why we saw Dawn to provide a character witness. I'd say this whole thing could be wrapped up soon. Prosecution summation will be interesting - I'm not totally convinced they're certain about what happened.
