Benji Marshall Assault Charge Dismissed

Thanked his teammates "who the coach wouldn't let come and sit in court" and finished with "now let's play Rugby League" before departing

Great relief for Benji and the the team I'm sure. Thankfully justice has prevailed. What a waste of money ,time and stress.

Good outcome. Good that the nrl let the courts decide before taking any action at the time. Benji you are an asset to the game and the mighty Wests Tigers!

I almost feel sorry for what the tigers are gong to do to the Gold Coast now on monday night…. Marshall will tear them open.

Tigers by 60 points.

Not even kidding.

Sometime the police have to do what they did because they have no other version to go on other than the bloke that's allegedly been hit. Think about it. Cops get called to the scene, the bloke's got a split lip, says Marshall did it and his mates are witnesses that also say Marshall did it. Benji's gone so he's not there to offer his version with his mates as witnesses. Perhaps if he hung around with his witnesses and they all provided their versions of what happended, the matter may not have gone any further because of conflicting versions. Finally Marshall agrees to meet with police, lawyered up with his barrister and what is he advised to do ? tell the cops nothing. Thus the situation is created where all the cops have to go on is the victims version and his witness mates. Their hands are tied and so are the prosecutors at court.

Looks like a guy who's just had the weight of the world removed from his shoulders. It's almost a shame game day isn't until Monday - he looks ready to really cut loose and enjoy his footy!

Awesome news. Just a question, does that clown have to pay the court costs. I hope he does.

No. It's a prosecution not a civil matter and the Magistrate basically said he was assaulted but there was too much confusion about how it happened. At the end of the day, despite being a pelican, the guy has done nothing wrong and it was the Police who decided to waste 2 days prosecuting it.

Stoked for benji his family ,friends and west tigers . May all this be forgotten when he takes the tigers all the way in 2011!!! Hell yer!!

I do believe that either party can now take civil action to recover court costs, if they chose???..

terrific news for the tigers, us fans and of course Benji himself, now to put the whole matter behind him and have another man of the match performance against the cold toast next Monday night. Tigers by heaps!!!

That's true but extremely unlikely given 1) Marshall would probably just want to forget about it and 2) he'd be at long odds to get a favourable ruling. In a civil case the awarding of costs is a little more streamlined.
