Three cheers for inconsistency!

CB - this was a always a case for subjectivity & that is how it has been dealt with - which is entirely appropriate!!!

In Stewart's case he got plastered at a club function & later ejected from another licensed premises + they had Watmough's assault of a sponsor at the same function!!

Benji was found to have not breached the NRL Code of Conduct!!!!! (Unlike Stewart - regardless of the later court matter!!)

This is exactly the way it should be let the court decide …I hope the person that has made the allegation has nothing to hide because his life is going to be put under the microscope ..high powered people in play one thinks .

So in other words, the nrl has no faith in the WESTS TIGERS MANG!!!!! they dont come down hard enough they will step in and enforce a stronger penalty,

YGTBFK me!!!!!!! . Gallop is a dead set tool.. leave it to the clubs to make the punishment, but dont try and grow a set of balls after all the parties involved settle it..

If he is found gulity, so be it…. but guilty doesnt all ways make it wrong. The guy deserved to be smacked in the mouth and the person who was yelling.. pfft Australian Born: Middle Eastern Back ground....... why does that not surprise me at all...

Gallop is putting these players on a pedistille but expects them to be cocooned up for 12 mths while they are on top of it.. putting these players like Benji on a pedisitle is like putting a reg flag in front of a bull.. Every other team is going to have a go at you..

Red, it was more of a sarcastic shot at Gallop for getting it right for a change mate.

I half expected him to hand out some sort of preliminary penalty for being the face of league and getting himself into the situation but he has obviously reviewed the situation objectively and made a smart decision.

Whatever happened to the theory, that if you stand up to bullies they run away squawking?

That's exactly what Benji did, and exactly what the alleged "Australian born of middle eastern background" loser did. Ran away crying because he had a fat lip.

Man alive times have changed, and not for the better.

Regardless of where he was born or what background he is, he is a knob who got what was coming to him.

One interesting note, do you think the media would have been so hard on Benji if it was an Anglo male who made the comment?

i dont think Gallop got it right… he is only going to punish him if he is found guilty..

he should make up his own mind, he has the evidence in front of him. Unlike the Law he has a chance to look on the common sence side of things...

Good to go … Benji Marshall.
>
WESTS Tigers five-eighth Benji Marshall has been cleared to play in the opening rounds of the NRL season after league officials decided against imposing an immediate penalty over his assault charge.
>
The Tigers had until midday today to submit a report on the incident, in which the star is alleged to have punched a man.
>
Marshall's manager has said the Kiwi international had been racially abused.
Advertisement: Story continues below
>
The Tigers had felt that the judicial system should be allowed to take its course, and NRL officials clearly agreed, knowing the facts of the case are disputed and Marshall is not believed to have been heavily intoxicated.
>
On the contrary, Marshall had on the night in question hosted a fund-raiser for the Children's Cancer Institute of Australia, while witnesses said he had been happily signing autographs and posing for photographs before the fight broke out.
>
The fact that the incident came just days after Marshall had launched the season, placed some pressure on the NRL to act now, but they chose not to.
>
Marshall was charged with assault occasioning actual bodily harm yesterday following an altercation outside the McDonald's on George Street in The Rocks, Sydney, in the early hours of Saturday morning.
>
He will appear in Downing Local Court on April 20.
>
Marshall will now be named for the round-one clash with the Bulldogs on Monday night.

Anyone who thinks punching someone is ok just needs to think back to the David Hookes incident.

Yep. If you want to punch someone go join a boxing gym.

To many peeps are supporting this behavior when they shouldn't be. I support Benji but I recognise he is human and makes mistakes. This is a mistake.

Call me stupid, but I honestly think the racist comments and actions from that douchebag are far worse than the reaction.

One doesn't happen without the other. It depends on the level of the reaction. A split lip is hardly something to cry about. Benji didn't deck him, didn't king hit him, did no more damage that the fool would probably inflict on himself.

I agree completely Hammer.

guys get serious, if 8-or 10 blokes of middle eastern appearance supposedly - tanked to the gills with alchohol, or potentially other substances, hurl abuse at you, whilst you are with your girlfriend, just you two - would you go ahead and punch the guy or just walk away and it ignore it. really - be serious. which alternative is common sense and prevails?

Cheers CB - I thought that was the case - but I felt the need to contextualise it for the benefit of other readers who may think otherwise!

Good decision by Gallop - while many others of his could not stand-up to such scrutiny!

You can be forced into taking action, action which isnt always right or legal…..but hey lifes a [This word has been automatically removed] (rhymes with witch) and theres scumbags everywhere....ask any cop.
When it all boils down to it though.....it appears he hit someone and you cant do that - NO EXCUSES...according to the law.

Just because he has been charged does not mean the charge is VIABLY PROSECUTABLE at law!!!!

Alot of water to go under the bridge yet ladies & gents!!!!

it was likely to result in further significant action from the club or the NRL if proven.

This is Benji's problem. If he pleads guilty or is found guilty, the NRL is likely to impose further **significant** action. My understanding is that it will be very difficult to argue the facts surrounding this particular case. Let's hope the explanation surrounding the racial comments for his actions stands up - because there is no defense to assault (other than self defense and permission) and as far as I can see, the only result should this proceed to the Local Court will be a plea or finding of guilt.

x 2 t-rexx. the cowardly pig who squeeled has probably never ever did anything for the community, except probably doing parole community service, and yet genuine good guys like benji can be easy targets for such lowlife scum. benji's record of fundraising and genuinely helping disadvantaged kids is second to none and yet scumbags who have no idea or understanding of what being an aussie means can be allowed to harass whoever they like. i dont buy the crap about being ' in bed by midnight ' either. anyone should be able to go to macca,s or wherever without fear of being harassed etc.
