Subject: Request for Refund of Membership Due to Failure to Deliver Agreed Services
To whom it may concern,
I am writing to formally request a refund of my Wests Tigers membership for the current season. This request is made due to the ongoing situation with the club’s board, which has resulted in a significant failure to provide the standard of service, governance, and representation that I, as a paying member, reasonably expected and signed up for.
When I purchased my membership, it was on the understanding that the club would operate under a stable, competent, and properly functioning board, providing transparency, accountability, and leadership consistent with what was promoted to members. Recent events and the current instability at board level clearly demonstrate that these obligations have not been met.
Under the
Australian Consumer Law (ACL), consumers are entitled to services that are provided:
- with due care and skill,
- fit for the purpose for which they were purchased, and
- delivered as agreed.
At present, the governance of the Wests Tigers does not meet these standards. The issues surrounding the board have directly affected the club’s ability to deliver the service that forms part of the membership value — namely, stable administration, proper governance, and the level of organisational integrity that members are promised and rely upon when deciding to purchase a membership.
Given that the club is not currently providing the service as advertised or reasonably expected, this represents a
failure to meet consumer guarantees under the ACL, entitling me to a remedy. In this case, I am requesting a
full refund of my membership due to the service not being delivered in the agreed manner.
I ask that my refund be processed within a reasonable timeframe. Please confirm receipt of this request and outline the next steps required from my end.
