In many peoples eyes it makes then guilty immediately.He will have his time in court to defend the charges.It is an appalling crime he has been charged with and i would hate to be one of the jurors

Our daughter has just had a baby and she asked us to find her baby photos to compare her to bub.
We found one photo in her birthday suit and she asked me to send it to her on my phone, I say no way was I going to send a nude photo of a baby on my phone.
How things have changed, and for the better.
 
I was struggling to understand what the charges exactly were, but from reading the recent DT article it says that "Brett Finch vows to fight charges of commenting on child abuse in an online chat room". Guess that makes it pretty clear then

But here we are, moving on through another period of horrible headlines which bring the game down to yet another horrendous low point. Thankfully, Brett never played for our club. Buzz and co. would be all over us again if he had. I don't think we'll here Ex rooster or Ex storm player at the top of the story though.

They do get it wrong, and of course not all charges result in a guilty conviction. But as I said earlier I think a charge like this is more likely to stick, than the kinds of he said / she said cases we're more used to with footy players, where accusations can sometimes be made for spurious reasons by jaded ex's and the like.

But in cases like this one, metadata doesn't lie, metadata doesn't hold grudges, metadata isn't trying to get famous.

So speaking as someone with a relative who works in the NSW Child Exploitation Internet Unit I have a little bit of background on how these operations go down.

Generally for someone to be arrested he has had to show intent/possession or discussions around it. The police would have to have transcripts or solid evidence of one of the above (usually through infiltration the group chats) for him to physically be arrested and his possessions ceased. So to a certain extent you are correct in saying there is a probably a very good chance he's already guilty of something. Others have mentioned cops can get this stuff wrong which is true, but the fact that they arrested 8 others on one day means it was most likely a lengthy undercover stint and they would have their evidence to back it up (they couldn't afford 8 mistaken arrests).

Based on what I have read Finches best case scenario is he was apart of group chats or speaking to an undercover agent where sharing was involved - even if he has physically never shared a single image in the group he has still shown intent by being part of the group. In the courts eyes he is already guilty to a certain degree but usually this does not warrant jail time (hence being released on bail). He will have tough sex offender restrictions emplaced on him.

His lawyer would be pushing for either accidental inclusion in the group or going down the mental health/fantasy route - again the fact that 8 people were arrested probably means this has been a lengthy process and doubt this works.

If however he has participated in sharing/discussions this can warrant usually a minimum of 6 months and up to 2 years in prison. They would now be going through all his tech possessions attempting to prove this and get the full picture. Of course anything more serious than that he gets much longer.

Always innocent until proven guilty and I hope he get a fair trial if this was a misunderstanding, but for him to be arrested doesnt look good on his behalf. Feel for his wife and kids the most.

Again, fair enough. But that is referring to a case where Hayne was found guilty after a judicial process (I think for more than biting the love curtains, but I may be wrong). There is no judicial outcome on the Finch allegations yet. I just think we need to be careful.

The judicial outcome of the Brett Stewart case was that he was found not guilty on all charges and you weren’t careful around that?
