Because there was an allegation that the alleged victim and his goon mates were baiting Benji and his girlfriend in the restaurant prior to the alleged incident. Maybe the cctv inside the joint is inconclusive of this and it is favourable to the Crown for it to be submitted.

I don't forsee any issues for Benji. The burden of proof is on the prosecution to prove Benji actually hit this clown and it seems as though their evidence is paper thin.

Not really. If there is a back up charge of Common Assault laid, then Benji would be found guilty of that as the evidence states, he pushed the alleged victim.

A mere push easily constitutes common assault.

I'm embarrassed for this Soliman guy. Hopefully he never lives this down as the loser that tried to get some fame by baiting an NRL player.

Hopefully this gets dismissed fast.

I think its a strange thing for a witness for the crown to say in evidence.

"pleaded with Marshall to walk away, its not worth your career" after the punch, isn't that what Marshall did, or did i miss something ?? 😕 😕

Over the years he has raised hundreds of thousands of dollars for the sick and underprivillaged people of our society. He is amazing."

Very well said Bug, it is this type of work that shows Benji's character and I trust will assist him when the magistrate weighs up the evidence put before the Court. Good luck Benji on this occasion the community has an opportunity to pay one back.

I don't think it will have any bearing on the magistrate weighing up the evidence.
What it will definitely have a bearing on is if he is found guilty, and the ensuing sentencing report.

It is extremely obvious why the cops decided to lay charges on Benj - it relates to their inability to ID the alleged 3rd man in!!

The fact that he was charged is a disgrace. It's a 50/50 incident. Hundreds of these get written off every weekend by the cops.

The whole case is a disgrace.
 
The "victim" made a triple-0 call? Just how the hell would that have went???

Can anyone confirm what Benji was actually charged with? The only info I can find is for 1 charge of Assualt Occasioning Actual Bodily Harm. If this is the case my understanding is they need to prove that Benji actually punched this moron. Which from all reports the prosecution will struggle to do as all INDEPENDENT WITNESSES have stated they did not see Benji punch the man. So hopefully this will be what transpires today when the defense deliver their case and this unneccesary distraction can be dealt with and the boys can continue their fine last season resurgence!!!!!

Depending on your defence, it could be very strong.

I think it goes toward indicating that there were 'a number' of others at the scene, all dressed neatly and in close quarters. In a situation like that it would be very hard to identify exactly which person was the alleged offender. There is nothing on the CCTV footage that indicates who the alleged offender may be, hence nothing supporting the alleged victims claim that the alleged offender was Marshall. Only the word of the alleged victim and any witness he has supplied.

Then we go into the next stage of testing the credibility of the alleged victim and his witnesses. If the defence team do this (as they usually would), the alleged victim will be seriously tested on his general reliability, and his ability to identify someone when he is moderately intoxicated, with lots of people milling around in a scuffle situation who all look and dress the same in partial darkness.

Suddenly as there is now some doubt over the alleged offenders ID, and the prosecution must prove 'beyond reasonable doubt', it is not clear who or which alleged offender or offenders caused what damage, if any.

Should it continue in this manner, it would be very difficult to convict on this evidence…...
 
Very surprised the DPP didn't drop this case. There appears to be a lack of evidence and I would say that if it involved a ordinary joe blow it would have never got anywhere near a court room. I think the judge will toss it out very quickly.
