now that Benji has to attend court, it would be good to see the other party charged with , offensive language/behaviour.
then watch what happens.

That is until the first mention date. At that appearance, Benji will either plead guilty or not guilty. If he pleades not guilty, it will be set down for hearing about 3 months further down the track. If he pleads guilty, it will be dealt with there and then.

My advice, plead guilty with an explanation. Considering the actual bodily harm involves a split lip - this is at the very minor end of the scale when it comes to ABH. An early guilty plea will bring about a lesser penalty. He can argue the racial abuse (and there will be no opportunity for the prosecution to argue against this) As a clean skin, he will probably cop a fine and a good behavior bond. ALl finalised in 6 weeks. A please of not guilty could drag on for 2 months or more, and will involve a massive media circus.

Plead guilty - get it over and done with.

once he has made a complaint to police, they have to follow it up.
otherwise, the victim could complain then the investigating police themselves could end up being charged with neglect of duty. which can snowball into them being dismissed from their job.
so regardless of who the "alleged" offender is, once complaint made, they are interviewed, charged and put before the judicial system.
then its up to magistrate to decide.

If this is the case then he should be charged. I don't see why if Benji has been charged the other party has not been charged.
 
The guy raised 250k for childrens cancer research that very same night. I wish the papers/ch 9 would run a lead story on that every time he does it.
The only other thing, this has happened (been provoked, racially even) at least 1000 times to benji over the last 5 years and he has been the bigger man 99% of the time. What was it that made him react to this particular idiot?

I havent read a word on this from Benji.

I fully support Benji in this and while he was clearly provoked as a member i am more concerned that this could have had a very different ending. How did Benji know that this was going to end in one punch? What if the anal crater spoiling for a fight could actually throw 'em or had training in a martial art and wanted to prove himself? He could have made a mess of Benji and really hurt him- and that scares me more than any media beatup!! Also it just goes to show that nothing good comes out of anything that happens after 2 a.m.

Ink apparently (but who knows) the guy presented with a facial injury. Better to admit what happened and play it by the rules than to try and deny it.
There can be surely no action on this by the NRL. They have suspended players for racial abuse - the racial abuser that is (no doubt after retaliation) so that would appear to be the exact scenario here.

What a **[edited by mods]** joke. I mean, has anybody in the media stopped to think that Marshall was actually the one who was provoked? The guy has just been named as the new 'face of the NRL' and was coming back from a function to do with raising funds for children's cancer foundations, I mean is the guy really going to look for a fight? It's a joke, this could now have a detrimental affect on our playing group and preparation, knowing that their key player may not be playing in the first match of the season and is up for assault. I hope it doesn't have a similar affect to what happened with Manly in '09, when Brett Stewart was charged, missed the first four games and subsequently Manly lost those four games.
 
Errr I didnt say anything about denying…...I think its better to keep your trap shut and let a legal mouthpiece do all the talking, you just get yourself in bigger do-do telling the cops, and in Taubers case the media, stories, they often encourage one to continue on...even sometimes resulting in people saying things they dont mean to say.

i know i may be wrong here but, for marshall to respond i reckon something else was said, the first time i reckon they went on saying shit such as black c*** and go back to NZ etc, but when they realized that wasn't working i reckon one of em said something about his GF which lead to the response, i may be wrong but that's my prediction.

If Marshall gets suspended for this i will be extremely surprised, maybe if alcohol was an influence in the event it may be a different story but i can see alot of nrl greats, and others getting behind him and supporting him.

channel ten haven't had their two cents, so this is how they catch up.

nine broke the news

seven added the whole hes now been charged.

ten didn't have any scoops and as usual sat on their hands when a story was starting to boilover, so they threw that line in for good measure.
