Judiciary bans Bears biter for 10 matches

NORTH SYDNEY winger Mitchell Stevens foreshadowed an appeal last night after being found guilty of biting the ear of Balmain-Ryde player Jason Schirnack – which led to a 10-match suspension.

Stevens declared his innocence after a marathon hearing despite the guilty finding, saying afterwards: "I still maintain my innocence, and the truth doesn't always come out. That's all I'll say."

Bears representative Darren Allard suggested Stevens and his legal team was considering an appeal.

What has been ruled to have been a split-second decision by Stevens was dissected over for about five hours at the NSWRL's Phillip Street headquarters, which ultimately came down to a he said/he said scenario.

Stevens said the injury was caused by a punch to the ear, and that he had performed a wrestle manoeuvre while the pair were on the ground. Schirnack had claimed he had felt a "pinch" sensation while they were on the ground. And so the three-man panel of Sean Garlick, Graeme Wynn and Mark Coyne were left to decide between a pinch and a punch on the first day of the month.

The testimony was long and arduous, and resembled at times a circus. The television froze at an inopportune moment. The prosecution quarrelled with the defence. At all times Stevens was relatively motionless, but repeatedly declared that the allegations were "completely untrue".

During testimony Scott Byrne, the Balmain-Ryde doctor, said a "punch would not have caused that injury".

"The player stated that he'd been bitten and the wound was consistent with a bite," Byrne said. "It was my opinion it was a bite.

"There was skin missing . . . it just can't happen with blunt trauma. A piece of his ear has actually been taken out. It requires something to be cut through the skin . . . a piece of skin, a piece of ear, can't be punched off. It just doesn't happen. A chunk of his ear, to put it bluntly, has actually come off. I challenge anyone to show how a piece of skin can be punched off."

Cue former kick-boxing world champion, Grant Barker, who testified that, indeed, it can happen. And in 1994, in a bout involving Eugene Valerio in Japan, it actually did. "A hundred per cent it is [possible to punch a portion of ear off], depending on the angle and where the blow lands," Barker, a North Sydney trainer, said, during one of the more colourful exchanges of the hearing.

Stevens said he had worn a mouthguard during the exchange, during the second half of the clash between the two sides at North Sydney Oval last Sunday week. He even gave a demonstration of his grapple hold on Schirnack, using one of his legal team, which he argued meant it was impossible for him to bite his opponent's left ear. Showing the panel members a swollen right knuckle, he said he had been "shocked that I'd been accused of that, because I thought there was no possible way . . . I was angry after the fact."

Schirnack said the feeling of having his ear bitten was similar to when his ear was pierced, likening it to an injection. "He was on top, I was on the bottom," Schirnack said. "I felt a bit of a pinch on my ear. We all got up and I noticed I was bleeding from my ear."

He said he called Stevens a "dog" when it dawned on him what had occurred. After four hours of evidence, the panel deliberated for half an hour before finding Stevens guilty, even though the Bears winger's counsel, Les Nicholls, showed stills that he said showed a discolouration of Schirnack's ear immediately after the punch.

Nicholls maintained that Schirnack did not realise he had been bitten until his club's medical staff made him aware of the nature of the injury.

"When you got up, you didn't realise that you'd been bitten," he asked the Balmain-Ryde player. "No," Schirnack replied. "[But] I knew something like that had happened."
 
10 weeks? What a joke! Didn't that Bulldogs player get 8 weeks for barely leaving a mark? :astonished:

Yep 8 weeks for biting an elbow. The NSWRL considered that and added an extra 2 weeks for an ear. Still laughing at the "I punched it off" defence. If that was true he should retire from league and take up boxing. There'd be bits of people flying off everywhere - he could literally knock someone's head off…

The SMH today reports he is appealing the decision and is trying to implicate the Balmain doctor as giving false testimony. They also reported that Stevens admitted in court last september to severely biting the face of another man in self-defence during an Australia Day brawl (and racially abusing the protagonist).

He is also facing a separate assault occasioning actual bodily harm charge currently from a brawl at a Caringbah pub.

Talk about having form…. typical shire scum!

Jason Schirnack is still playing top footy and I hope he gets more of a run in the top grade next year.

MITCHELL STEVENS has bitten before. The Herald can reveal the North Sydney fullback, who was suspended for 10 matches for biting off a chunk of the ear of Balmain Ryde forward Jason Schirnack in a NSW Cup match, has admitted to biting the face of university student Timothy Amassah in an alleged affray last year.

The incident was heard in Sutherland Local Court last September. Under cross examination from Amassah's solicitor, Paul FC McGirr, Stevens confessed to biting Amassah during a brawl on Australia Day.

The transcripts of the hearing, obtained by the Herald, involve the following exchange:

McGirr: After you've tackled him to the ground he wasn't hitting you, was he?

Stevens: No, he was trying to.

McGirr: And then you bit him?

Stevens: Yes.

McGirr: On his cheek?

Stevens: Yes.

McGirr: Very hard, with some, with some great force didn't you?

Stevens: Yes.

McGirr: You sunk your teeth in his flesh?

Stevens: Yeah.

Stevens was questioned as a witness in the assault trial against Amassah. In court, Stevens admitted to being intoxicated and racially abusing Amassah, who was convicted of assault. Amassah has appealed against the verdict, and it will be heard in the Downing Centre District Court on November 29.

Asked if he was a serial biter, Stevens's only comment last night was: ''All I can say is that I was fighting for my life.''

His father, Brett added: "We have been advised not discuss this matter, but I would like to say one thing, and that whatever he had to do was all worth it when the boy's parents [the parents of another person involved in the fight] thanked Mitch for saving their son."

The Herald has learnt that Stevens has been charged with assault occasioning bodily harm in a separate incident at the Caringbah Hotel last year. He has pleaded not guilty, and the case continues.

Stevens has pleaded his innocence in the Schirnack case, claiming that he punched off - rather than bit off - the ear of the Tigers player. Stevens will appeal the NSWRL judiciary's decision at a hearing next Wednesday night.

The Herald has obtained a letter from Stevens's father to Bears CEO Greg Florimo which outlines key points in their appeal. It questions the testimony of Tigers doctor Scott Byrne, and states that: ''If all goes according to plan we will have a case to report the doctor to the medical association and sue him for damages''.

Byrne gave evidence that the damage to Schirnack's ear was, in his professional opinion, the result of a bite rather than a punch.

The letter states that evidence will be submitted from ear, nose and throat specialist Professor Thomas Havas countering Byrne's claims, as well as plans to seek the opinion of renowned boxing doctor Lou Lewis.

''I hope that you can understand why we are continuing to fight these charges as it would be so much easier to simply give up,'' Brett Stevens wrote. ''I think we all realise that this has effectively ended his career and not only cost a great deal of money in the short term, but potential future earnings in the long term - not to mention his reputation.''

Even if he is acquitted at the NSWRL appeal, Stevens has played his last game for the Bears.

''He won't be involved with next year's squad, regardless of the outcome,'' Bears operations manager Brent Pigram said.

Saw that in the SMH. I am reading it right? Florimo and the Bears plan to sue Scott Byrne for damages and report him to the medical association for giving the opinion that when someone's ear came off it, it was probably due to a bit more than a punch??

Well there goes any support I had for the CC Bears. If that is accurate, Florimo is a clown of Osborne-esqe proportions and shouldn't be allowed anywhere near the NRL. And then to top it off they are punting the bloke anyway. Well which is it Bears? Are you backing him and questioning the integrity of Dr Byrne or are you washing your hands of this grub?
 
I am unsure whether Florimo is supporting the appeal or potential law suit - but they as a club have been far from strong or consistent in their response to the incident.

While it was widely reported that they sacked him - they never made a formal statement to confirm this - and they allowed their club trainer to support his original case (including supporting the ear-punch version).

I believe Florimo is a clown - and forget about the CC Bears - on Talkin' Sport he stated that the CC could not afford a team of its own without the support of big business on Sydney's north shore.

North Sydney never had the support of local business - so why would the north sydney business community financially prop up a region that cannot afford a team of its own???

The guy sounds like a complete numpty. Probably has an Aussie Pride sticker on the car and the Southern Cross tatooed on his back to boot

Uh huh. Yeah reading it back I see that now. Well they'd be a million to one getting anywhere on the legal front. Still Florimo could be a bit stronger in his comments on the matter.
 
I agree. I actually took a similar position on Florimo after the inaction not only agains tthe player but agains tcoaching and management staff trying to racially vilify Jason as he was leaving the field as well
 
What are the odds of him punching a small piece of someones ear off instead of him biting his ear? Then is it just a coincidence that he has been known for biting someone in a fight before? And is it another coincidence that Frank Bumper Farrell who did the same thing was his grandfather's godfather? He is probably proud that Frank Bumper Farrell is his grandfather's godfather and it looks like he has been trying to act just like him for a while now. Sounds guilty to me.
 
Suprisingly I've played in a league match where a piece of ear has been torn off, a player got a piece of ear caught in the opposition players jersey and it ripped. That was a tearing motion however, a punch is a crushing style force, I just don't see how the two correlate. 10 weeks is also a joke of a sentence. Part of me wishes the guy gets a contract next year, so that he can replay a BRET or Wests tigers combined team and get his pay back.
