Wests Tigers

The St George-Illawarra Club has advised that they will not be pursuing the registration by the NRL of their contract with Tim Moltzen.
>
Wests Tigers is pleased that this matter has now been resolved and that Tim Moltzen can begin to focus solely on his footballing commitments for season 2012.
>
The Club has acted in good faith and in line with all NRL rules. Furthermore we have co-operated fully with the Salary Cap Auditor and complied with all requests during the investigation of this matter.
>
Chief Executive Stephen Humphreys said that he is pleased that the matter has now drawn to a close.
>
**“Whilst the statement released by the Dragons today includes certain inaccuracies, we do not see any merit in publicly debating these items.**
>
“We understand that the Dragons are feeling disappointed and disadvantaged but it only serves to reinforce the value of following the generally accepted protocols and procedures that apply in such situations.”

Interesting…

HAHAHAHAHAHAH That's a brilliant statement! Beautifully professional way of saying 'shove it up your jersey you petulant 3yo doust'.

Not necessarily a fan of the way this has all played out but it's worth it just for that statement.

i wonder if it would be different if Adam Blair did the same thing to the Tigers

Hard thing to imagine given Blair wasn't contracted to Storm for 2012.

Moltzen isn't the first player to sign and then want to stay. In recent years Luke Lewis/Inglis/Elford/Turner have all supposedly agreed to terms and then backed out.

Not to mention the numerous other players and coaches who sign for 4/5 years and never see it out.

I don't think its great to see players do what Moltzen did. But I think we have to put it all in perspective, contracts have been a joke for a long time now.

this is why NRL is kind of amateurish compared to other sporting organisations

Its not like other codes don't have contract issues though. The NRL being amateurish is more a reflection on the codes inability to pull itself together behind the scenes with the IC and back office dealings.

Thank god it's all over and can move on and talk about another topic. Also if he in fact has a crook shoulder let's hope he gets over it quicker than his knee job

Shoulder injury that requires rehab. Great. Cant wait to hear the excuses for six months as to why he isn't performing…zZzZzZ

And the Dragons have now well and truly spat the dummy…

NRL Dragons may sue Tigers over Moltzen

Furious St George Illawarra officials will consider suing NRL rivals the Wests Tigers for damages after the Dragons were forced to pull out of the battle for star utility Tim Moltzen.

The Dragons on Thursday conceded a release for Moltzen from the final year of his contract with the Tigers, which had been considered a formality, would not be forthcoming.

St George Illawarra chief executive Peter Doust had referred the issue to NRL salary cap auditor Ian Schubert when Moltzen had a change of heart after signing a three-year deal with the Dragons in July.

The Dragons also accused the Tigers of changing their tune after initially allowing Moltzen, who starred during Tim Sheens' side's run to the finals, to look for other clubs.

In further developments on Thursday, the Dragons said Moltzen had not disclosed a serious injury to them, while the player's manager Martin Tauber will be investigated by the NRL's agent accreditation committee over his role in the affair.

"The Dragons still firmly believe that Tim Moltzen should have been prepared to fulfil his commitment to the three-year contract he and his manager Martin Tauber signed on July 12," a club statement said.

"Furthermore, the club will be investigating the pursuit of its legal remedies against the Wests Tigers, for damages."

Schubert found the lack of a written release from the Tigers meant he remained contracted to that club.

Doust said he had met Tigers boss Stephen Humphreys this week.

"This meeting confirmed that Tim Moltzen wanted to take advantage of the changed circumstances presented by Wests Tigers and was not going to honour any of his previous commitments," Doust said.

"At the same meeting, Tim also revealed that he has been carrying a shoulder problem for most of the 2011 season.

"He in fact told me that his surgeon had advised that very morning that his shoulder would require six months of rehabilitation.

"The shoulder injury was something that Tim or his manager had not previously disclosed."

The outcome leaves the Dragons in a hole because Moltzen had been signed to cover the loss of Newcastle-bound fullback Darius Boyd.

"Notwithstanding this decision, the club will not be rushing into signing a replacement player, even though Wests Tigers offered to subsidise a player transfer," Doust said.

The Tigers, who had objected to the timing of the Dragons' announcement of the signing in July, said they had acted in good faith and not breached NRL rules.

"Whilst the statement released by the Dragons today includes certain inaccuracies, we do not see any merit in publicly debating these items," Humphreys said.

"We understand that the Dragons are feeling disappointed and disadvantaged but it only serves to reinforce the value of following the generally accepted protocols and procedures that apply in such situations.

The NRL said Tauber's failure to secure a written release from the Tigers before entering into another contract would be reviewed by their agents' committee.

Tauber is out of the country and was unable to be contacted.

Great to see a conclusion has been reached, not my favoured outcome but nonetheless it's an outcome.

Hopefully he strings a few more consistent performances at fullback next season.

That's fair enough, but I'm not seeing how the Tigers are at fault with this.

The Dragons announced the signing on the day of our game against the Eels and did so before getting an official release. The NRL ruled in our favour. I don't see where we can be sued if there is nothing official in writing saying we'll release him.

I imagine this is one of the reasons why it took so long to get an official announcement on Blair, they had to make sure all the I's were dotted and T's crossed.

Dousts argument seems to be "they really really really sounded like they were going to release him!".

yeah it's a "oh but you promised!!!", I'm waiting for him to go stand in a corner and hold his breath.

Tauber, however, may end up struggling out of all this, if he's assured the Dragons that Moltzen was going, I can't imagine the Dragons would be interested in dealing him with for some time and other clubs may be wary. In saying that, if they just waited for something official from the Tigers rather than relying on a player manager's word, then we may not have heard too much about all this.

It is nice that some of you are gloating about all this and criticising Doust. But really it is a messy situation and I don't really think that St George can be blamed for the way they acted and their bitterness now. While there was no official release, the Tigers were clearly willing to let Moltzen go. None of the comments after the signing showed any sort of doubt about the validity of the contract.

It is also clear that the club had a change of heart and were able to change their mind because of the sloppy work by the Dragons and Moltzen's managers in not receiving written confirmation of Moltzen's release.

I am glad the Tigers have chosen this course of action and have changed their opinion even if the decision is morally questionable. I also don't think Moltzen is to blame and I'm glad we have a player so keen to be at the club. But the club looks bad at the moment and I think we just have to wear that. I don't think it is anything to gloat about though.

If the Saints were going to be able to take legal action against anyone the only person they may have a case against is Tauber
But that isn't going to be easy to prove
