Obviously Doust is an amateur when it comes to contract law as he announced Moltzen's signing to the world before he had all the legally binding paperwork!!!!!

The basis of a contract is offer and acceptance. There is no requirement, in either legislation or at common law, that a contract need be in writing.
Acceptance may be subject to the fulfillment of specific conditions. If those conditions are not met, acceptance may not occur and no contract therefore exists (Masters v Cameron, 1954)
I have no idea how the Moltzen thing played out, but frankly I don't care. He's playing with the Tigers next year and thats all that matters. The number of posts in this matter are ridiculous
Wonder if this is the first time specific case law has been mentioned on the forum. Vaguely remember Masters vs Cameron from my very basic law subjects, my biggest memory from contract law was if in doubt, Boots cash chemist was always a good guess, same with neglience, if in doubt Donahue vs Stevens :slight_smile:
I think that as usual people are being very hard on Tim with this one, he is a young kid with presumably little knowledge in the area of contracts dealing with experience business men in Humphreys and Daust, he is extremely reliant on the support of his manager, who it seems may have provided him poor advice in this situation.
