Contracts have pre-conditions.
Contracts for the sale/purchase of a house sometimes have as a term of the contract the pre-condition, "subject to finance".
Which means that unless a third party to the contract (ie a bank) lends the purchaser the money to buy the house then there is no contract.
Contracts for the sale/purchase of an NRL player that is already a contracted player with NRL club "A" by NRL Club "B" have "subject to a deed of release" from Club A as a pre-condition to the contract.
No deed of release from Club A with the player = no contract between Club B and the player.

Contract law is very straight forward, but both sides will have gotten advice from their lawyers who would have told them they have a leg to stand on, which makes me think the dragons are probably going to argue there was some kind of 'intention' or something to the effect of a verbal agreement in gravity. "It's the vibe of it".
 
Meanwhile, besieged Wests Tigers utility Tim Moltzen also spent yesterday immersed in talk of promises, commitment and contracts bound by a higher power than even David Gallop.

"Ahh, can't really talk - I'm at a wedding," Moltzen apologised down the phone line when quizzed about his ongoing contract dramas. "Besides, there's nothing to really say. Not until everything has been sorted."

But please, no holding your breath league fans.

Because while NRL sources are saying Moltzen should know sometime this week - and perhaps as early as today - whether he is to be a Wests Tiger or St George Illawarra Dragon in 2012, we would like to remind you about that little thing called Independent Commission.

You know, the great institution to save rugby league … if only it could save itself.

Molzten, Carney, the Commission, even those feudin' Eels - all of them swirling about in what is quickly becoming the NRL's very own version of Stilnox. Set to be sorted in around the same timeframe as the American Civil War.

As of last night, NRL salary cap auditor Ian Schubert was still unravelling the Moltzen mess. While Schubert is remaining silent until a decision is reached, it's understood St George Illawarra officials appear resigned to losing the 22-year-old utility - and housemate of Tigers superstar Benji Marshall - who is desperate to remain at his current club.

Even if Schubert, who has been reviewing all relevant documentation since Wednesday, confirms the Dragons are to get Moltzen, it's understood a compensation deal will be hammered out, allowing him to remain in the black and orange.

An article in yesterdays Sunday Mail up here suggests that now the Saints are going to make a last ditch attempt to sign Todd Carney to replace Moltzen as well as the compensation they will seek from us
No doubt the compensation will be centred around Mitch Brown

Now lets see what (if anything) we have to hand over, wait for the dragons to have a whinge (probably to the press and probably before they know what the facts are) and move on.

From what I've heard this morning is that shubert ruled that the tigers have the only registered contract with the nrl that the dragons failed to supply full details as well as a formal release from the wests tigers of tim moltzen.

There was no letter of intent from wests give to tauber to use in negotiations with other clubs at the time he was told he could talk to other clubs.

Tauber could be fined or dis credited for mis representation.

Based on this I think wests have won the battle and won't even have to compensate them.
