That's fairly standard procedure in courts and tribunals. After guilt is determined there is a determination of penalty. Given that the submission on behalf of James was that he was not careless at all it would have been obvious to them that his counsel should contest the grading.
Obvious to who?
Shouldn't his counsel be aware of this and if not too bad…. A bit like referees coaching players onfield

Because the elements of the charge remain the same (unlike in the murder v manslaughter example) and the grading just reflects the degree of seriousness of the offence. There is no sentencing process outside of the grading because the grading dictates how many points the player will receive. If you were going to liken it to murder sentencing then it's like the difference between say 10 years for a grade 1 murder (like a battered wife who doesn't get up on self defence or provocation) and life for a grade 5 murder (like a contract killing of a Crown witness). Same offence and same elements but a different penalty to reflect the seriousness of the offence.

Well said, the Tedesco thing was a farce, okay James may have had a defence with the rule being written as it is, but if that is the case than the rule has to be changed and the NRL has to have the power to make rulings outside the rule book. Take the two ball thing against the Knights this year, the NRL came out and said there was no rule that covered that incident, thats a cop out, they needed to make the obvious call and say it was not in the spirit of the game…as with the Tedesco thing.
The NRL under Greenberg is still no different to any other administration they have had in the past, plenty of talk and no action
