Not sure what to make of this!

It happens all the time in DV matters. There is a period where victims are initially compliant with police but then forgiveness and/or the realisation of financial dependence or any one of a hundred other things enter the frame and they become reluctant or hostile witnesses. It has been such a problem over the years that legislation was introduced whereby the evidence of victims of domestic violence can be recorded shortly after the event and can be played in court (a DVEC interview).

Matters can still be prosecuted even with a hostile victim, especially if there are independent witnesses and if the victim has made an initial sworn allegation. The prosecutor just has to cross examine the victim using their initial statement as a prior inconsistent statement in that kind of case.

Wasn't Walker's assault witnessed by neighbours? They can still use their testimony can't they?

Yeah 100%. Still going to have to deal with her as a witness though. I guess it depends on what they mean by a "retraction statement". That could mean anything from a statement saying she no longer wants the charges to proceed (but not saying that anything she had previously said was untrue) to a statement completely contradicting what she said on the night and attempting to give him self-defence as an out. Just have to wait and see how it plays out.

The law has been changed so that the female can’t retract a statement as this often happens in DV cases.

No that is not what the change was and they would never change the law to prevent someone from making a subsequent statement or giving whatever evidence they want to give when a matter goes before court. The change in the law was to allow the initial recorded statement made by the victims to go into evidence regardless of whether or not that was the evidence they wanted to give on the day of the hearing. Previously you would have had a hearsay problem with getting an out of court statement like that in and would have to go through the process of making an application to cross examine your own witness and then get it in as a prior inconsistent statement.

Yes mate, if they have witnessed it, some reports were saying he pushed her in public causing her to fall over and end up with a couple of scrapes and bruises. Putting a hostile witness in the box without other witnesses is not usually done otherwise.
 
Looks like De Belin and another lower grade player now being investigated by police for aggravated sexual assault on a 19 year old woman. Read it on channel 9 news website. If found guilty, the NRL brand has got some real issues to deal with.

This is what really gets me thinking about some NRL players,Walker allegedly assaults his partner who has a child in her arms…DeBelin and a mate go to a hotel or apartment block with a 19 yr old woman while Jacks partner is at home pregnant...

Heres what gets me,the players are constantly in the public eye and some think they are untouchable because they play NRL,not only do they let themselves down but also family,friends,club and fans,YET they still go and do this crap..not making excuses but maybe Walker has a problem with anger issues that desperately need addressing,howeverDeBelin should not have even considered going to a place with a woman at all,especially that he is in a relationship and his partner is expecting..

Im really glad that my parents taught me right from wrong...never hit a woman and never be unfaithful if you are in a relationship...and Im just an ordinary bloke trying to make it through life doing the best I can...

We need to keep this in perspective. I'm not going to rubbish the game because of some (and I emphasise some) bad apples. There are plenty of quality men (and women) playing the game. Let's not tar them all with same brush.

We need to keep this in perspective. I'm not going to rubbish the game because of some (and I emphasise some) bad apples. There are plenty of quality men (and women) playing the game. Let's not tar them all with same brush.

Also totally not limited to rugby league - AFL, soccer, NFL, NBA - anywhere where young-ish men side-step regular adolescence and early manhood and instead get thrust with money and fame.

Yep. Even if you were never taught right from wrong and can't manage to be a decent human… it still takes a special kind of dumb to think you'll never get caught out when there are fellow players getting busted everywhere.

In life generally too many males see women as their slaves and the lesser sex , when they try to break that stereotype some unfortunately cop it

It is a tough subject as I have had family members caught in either side of the extremes 😢

Well my Mrs has enough rope to get to the letter box and the clothes line …....

I'm joking ....I'm joking but how many blokes do you know that refuse to do housework of any kind

Or when they go out the wife can't drink because he is .......

Or the bloke goes on bloke vacations while the wife looks after the kids

Or doesn't help with homework .....

The partner might love to do all this but can't .......the hubby couldn't cope
