When things starts to open back up for fully vaccinated people, does that also mean only fully vaccinated workers can go back to non-essential jobs? Or do the restriction only apply to customers? My wife is trying to find out because her workplace is opening back up, they don't seem to one and neither does the helpline.

Also, does anyone know much about how workers rights/health & safety/duty of care come in to play? My wife is pregnant, and it hasn't been easy (she has HG and GD, so already considered a higher risk pregnancy), so she is at a higher risk when it comes to Covid. She's due to get her second vaccination a week or so after her workplace opens back up, but is worried about going back to work before the 2 week period (if at all), but is also worried about losing her job over it. Any suggestions would be much appreciated (we've tried talking to the helpline and to safe work NSW, she's seeing a doctor today and we'll try fair work next week).

There is a big case in the high court in Sydney at the moment
When the decision comes down one way or another you will know but if the guy wins it will be illegal to ask for vaccinated status and to force vaccination on someone or discriminate against unvaccinated

Vaccination status has been requested for many years?

My understanding is that it has never been challenge in court until now

Abit like Terry Hill and the draft I guess untill it's challenge but I am no legal expert

A friend of mine was unable to get a job in an Abattoir in the 90s due to being unabled to be vaccinated for Q fever because of an egg allergy. I don't think the case would have a leg to stand on as it has been happening for decades.

Could be a disaster when it comes to companies trying to avoid deep cleaning. Next thing you know deep cleaning will be discrimination against the unvaccinated.

Have you read lately about deep cleaning of late you can do it yourself overnight with some chemicals I was thinking you had to get people in with Hazmat suites on or something they made it cheap and easy

And then a 2 week holiday is needed for everyone working in the premises.

No they cut that out you can trade next day

So there's no point letting the vaccinated out first and having people check in to restaurants and venues. I guessing you think the government is going over the top with making venues become vaxxed only until at least December.

Are we not all in this together?

Obviously not

If we want both out then 70% vaxxed won't be enough. We will need at least 80%.

This is the point, we are opening up at 70%, which is not high enough which is why the unvaxxed are still facing restrictions.

30% off NSW unvaxxed will still cause massive amounts of infections. Luckily for us 80 is going to be reached in a matter of time and only 9% are undecided.

People would be even less happy with the new government if that goes wrong. Plus I expect most companies to start with the vaxxed only route when it comes to customers in their venues.

I am over vaxx nonvaxx don't care

You might care if you get the virus.

Had it twice already last year was worst this year very mild but the one think that stands out from last year to this year was my lungs last year was on absolute fire just burning like a burn on your skin inside your chest crazy

Twice, really? Not impossible, but pretty sure if true that you would be the only individual in our nation, as to my knowledge there has not been such an occurrence here, so calling you out on this statement.

It may interest some of my more learned friends on the forum to look up a decision made on
the 27th September 2021 by the Fair Work Commission in regard to forced vaccination by Employers ..
This case is in regard to a lady being told she must be vaxxed against the flu or lose her employment..

Pages 32 through to 44 are most relevant to Covid vax mandates ....VERY INTERESTING and brings the Laws of discrimination, privacy act, civil liberties etc etc into perspective...

the Lady won the case....

reference...2021 FWCFB 6015...DECISION.....

Covid and Flu are not really similar. Are you comparing them?

NO MATE read what I wrote....its about vax mandates which INCLUDED COVID mandates...pages 32 through to page 44 of the Fair Work Decision...

I think you'll find the majority decision upheld the employer's right to dismiss the worker in these circumstances.
There was one dissenting opinion, but the majority of the Full Bench holds sway, not a single dissenting opinion.
ie. the employer "won"
Apologies if you're talking about a different case, but [2021] FWCFB 6015 is Jennifer Kimber v Sapphire Coast Community Aged Care Ltd

Short summary:
This week’s decision of the Full Bench of the Fair Work Commission in Jennifer Kimber v Sapphire Coast Community Aged Care Ltd [2021] FWCFB 6015 has hit the headlines, primarily due to comments in the dissenting opinion of Deputy President Dean regarding mandatory COVID-19 vaccinations.

Despite the hype, it is of course the decision of the majority which is critical for employers considering risk control measures in their workplace. The majority of the Full Bench found that, in the circumstances, the vaccination direction was both lawful and reasonable, and the employee’s refusal to be vaccinated rendered her unable to perform the inherent requirement of the role. The decision at first instance that her dismissal was for a valid reason, and not otherwise harsh, was upheld on appeal.
